1. Introduction

This Privacy Policy explains how Ice Cream Entertainment LLC, an Idaho limited liability company doing business as Permadeath ("Company," "we," "us," or "our"), collects, uses, and protects information when you use the Permadeath mobile application (the "App") and any related services (collectively, the "Service").

By downloading or using the App, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App. This Privacy Policy applies in addition to our End User License Agreement ("EULA") and Apple's Privacy Policy (https://www.apple.com/legal/privacy/), which governs the App Store and the in-app purchase mechanism.

2. The Short Version

In plain English:

  • You create an account with an email address and password (or, where offered, Sign in with Apple) so your runs and progress are saved to your profile.

  • Your data is stored on our backend. The expeditions you set, your goals and vice labels, your check-ins, your Hall of Runs, and your token balances are stored in our hosted database so they're tied to your account. Access controls restrict each account to its own data.

  • We don't sell your data. Not to advertisers, not to data brokers, not to anyone.

  • We don't track you across other apps or websites. No advertising identifiers, no cross-app tracking.

  • Apple handles all payments. We never see your card details — only a record that a purchase happened.

  • You can delete your account and data from within the App at any time.

4. Information We Collect

4.1 Information You Provide (Account & Profile)

When you create an account and use the App, we collect and store the following on our backend:

  • Email address — used to authenticate your account and for account-related communications.

  • Password — stored in hashed, non-readable form by our authentication provider; we do not store your plain-text password.

  • Display name — a name you choose for your profile.

  • Avatar selection and difficulty mode — cosmetic and gameplay preferences.

4.2 Activity and Usage Data (Stored on Our Backend)

As you use the App, we store data tied to your account, including:

  • Expeditions you create (name, duration, start date, status, completion data, end date, and cause of failure);

  • Goals and quest text you enter;

  • Vice labels you enter and their weekly allowance settings and tracking counts;

  • Daily check-in records (success/failure and timestamps);

  • Story progression data and your success and failure counts;

  • Token balances (free and paid) and a record of your purchases.

4.3 Information Collected Automatically

  • Device and technical data such as device model, iOS version, and language settings, used so the App functions correctly;

  • Authentication session data needed to keep you signed in securely;

  • Diagnostic and crash data, in anonymized form, to help us identify and fix bugs;

  • Push notification token, if you enable notifications, used only to deliver the notifications you've requested.

4.4 Information Apple Provides to Us About Purchases

When you purchase tokens through Apple's in-app purchase system, Apple processes the entire transaction and shares with us a receipt confirming the purchase, the specific pack purchased, and a transaction identifier used for fraud prevention and refund processing. We do not receive your name, payment card information, billing address, or Apple ID. Apple's privacy practices govern this transaction.

4.5 Information We Do Not Collect

For clarity, we do not collect: your phone number or postal address; your precise location (no GPS, geofencing, or location tracking); your photos, camera roll, contacts, or microphone data; your data from the Apple Health app; your social media profiles or friend lists; your browsing history or activity on other apps or websites; or your advertising identifier (IDFA) — we do not use the App Tracking Transparency framework to request tracking, because we do not track you.

5. How We Use Information

  • To operate the App — authenticating you and storing your runs, streaks, Hall of Runs, and token balances so they persist across sessions and devices.

  • To process token purchases — honoring purchases made through Apple's IAP system and crediting tokens to your account.

  • To fix bugs and improve the App — reviewing anonymized diagnostic and aggregated usage data.

  • To send notifications you've enabled — quest reminders, expedition status updates, and similar messages.

  • To communicate with you — account, security, and support messages, and responses to inquiries you send us.

We do not use your information for targeted advertising; profiling or automated decision-making with legal effects; sale to third parties; cross-app or cross-device tracking; or training machine-learning models on your personal data.

6. How We Share Information

We do not sell, rent, or trade personal information. We share limited information only in these cases:

  • With our service providers (processors) — including our backend/authentication provider (Supabase) which hosts your account and activity data on our behalf, our in-app purchase management provider (RevenueCat), and any diagnostic provider we use. These providers are bound to use the data only to provide their services to us.

  • With Apple — which processes App downloads and IAP transactions and delivers push notifications.

  • For legal reasons — if required by law, court order, or government request, or to protect our rights, property, or safety, or that of others.

  • In a business transfer — if the Company is acquired, merged, or reorganized, information may transfer as part of the transaction; we will notify users of any material change resulting from such a transfer.

7. Legal Bases for Processing (EU/UK Users)

If you are located in the EU, UK, or a jurisdiction with similar laws, we process your information under these legal bases: performance of a contract (to provide the App you requested, including your account); legitimate interests (to operate, secure, and improve the App), where not overridden by your rights; consent (for optional features such as push notifications, which you can withdraw at any time); and legal obligation (to comply with applicable law).

8. International Data Transfers

We are based in the United States, and your information — including account and activity data held by our backend provider — may be processed in the United States or other countries where our service providers operate. If you are located in a jurisdiction with cross-border transfer restrictions, you acknowledge such transfers may occur, and we take reasonable steps to ensure appropriate safeguards, such as Standard Contractual Clauses, where required.

9. Data Retention

We retain your account and activity data for as long as your account is active. When you delete your account, we delete your associated data through cascading deletion, subject to limited exceptions below.

  • Account and activity data: deleted upon account deletion, except where retention is required for legal, security, or legitimate business purposes.

  • Anonymized diagnostic and crash data: retained for up to 90 days, then deleted or further aggregated.

  • Aggregated usage analytics: retained indefinitely in aggregated, non-identifiable form.

  • IAP transaction records: retained as required by Apple's policies and applicable tax and accounting laws (generally up to 7 years in the U.S.).

  • Support correspondence: retained for up to 2 years unless longer retention is legally required.

10. Security

We take reasonable administrative, technical, and physical measures to protect your information. Data transmitted between the App and our services is encrypted in transit using industry-standard TLS. Our backend uses row-level security so each account can access only its own data, passwords are stored in hashed form, and access to personal information is restricted to authorized personnel on a need-to-know basis. No system is perfectly secure, and we cannot guarantee absolute security; if we become aware of a breach affecting you, we will notify you and any required authorities in accordance with applicable law.

11. Your Rights

11.1 Rights Available to All Users

  • Access — your data is visible within the App, and you can request a copy from us.

  • Correction — you can edit much of your profile and content in the App.

  • Deletion — you can delete your account and associated data from within the App at any time.

  • Portability — you can export your Hall of Runs and Expedition certificates from the App's Share menu.

11.2 Additional Rights for EU/UK Users (GDPR)

If you are in the EU or UK, you also have the rights of access, rectification, erasure, restriction of processing, data portability, objection to processing based on legitimate interests, withdrawal of consent, and to lodge a complaint with your local supervisory authority. 11.3 Additional Rights for California Users (CCPA/CPRA)

California residents have the right to know what personal information we collect, use, and disclose; to delete it; to correct it; to opt out of the sale or sharing of personal information (we do not sell or share personal information, so there is nothing to opt out of); to limit use of sensitive personal information (we do not use sensitive personal information for purposes requiring a limitation right); and to non-discrimination for exercising these rights. 11.4 Other U.S. State Residents

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws have similar rights. To exercise them, contact info@icecreamentertainment.net.

12. Children's Privacy

Permadeath is intended for users aged 17 and older. The App includes a feature for tracking the use of age-restricted substances (such as alcohol, tobacco, and cannabis), and our EULA and this Privacy Policy require users to be at least 17. The App is not directed to children, and we do not knowingly collect personal information from anyone under 17. If you believe someone under 17 has provided us personal information, contact info@icecreamentertainment.net and we will take steps to delete it.

13. Third-Party Services

The App relies on the following third-party services, whose privacy practices are governed by their own policies:

The App does not include third-party advertising, social media tracking, or marketing pixels.

14. Push Notifications

The App may send push notifications related to your expeditions and quests, such as check-in reminders and run-status alerts. By enabling notifications, you consent to receive them. You may disable them at any time in your device settings under Settings → Notifications → Permadeath. We do not use push notifications for advertising or messages unrelated to your use of the App.

15. Do Not Track Signals

Because Permadeath is a native mobile app and does not engage in cross-app or cross-website tracking, browser "Do Not Track" signals do not apply. Regardless, we do not track users across other apps or websites.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will update the "Last Updated" date above and, where changes are material, notify you within the App before they take effect. Your continued use of the App after the effective date constitutes acceptance of the updated Policy.
